By accessing or using SelfOS ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

SelfOS is a personal development platform that helps you build better habits, achieve your goals, and transform your life through habit tracking, goal management, AI-powered coaching, and analytics. The Service is provided on an "as is" and "as available" basis.

3. User Accounts

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

You must be at least 13 years old to create an account. If you are under 18, you must have parental or guardian consent to use the Service.

4. Subscription Plans

SelfOS offers both free and paid subscription plans:

• Free Plan: Basic features with limitations
• Pro Plan: Advanced features including unlimited habits, AI coaching, and analytics
• Business Plan: Team features and company-wide access

Subscription fees are billed in advance on a monthly or annual basis. You may cancel your subscription at any time, but refunds are not provided for partial subscription periods.

5. User Content and Conduct

You retain ownership of any content you submit to the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display your content solely for the purpose of providing the Service.

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Infringe upon the rights of others
• Transmit any malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service or servers
• Use automated systems to access the Service without permission
• Impersonate any person or entity

6. Intellectual Property

The Service, including all content, features, and functionality, is owned by SelfOS and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our explicit permission.

7. AI Coaching Disclaimer

The AI coaching feature provides suggestions and guidance for personal development. However:

• AI coaching is not a substitute for professional medical, psychological, or therapeutic advice
• If you are experiencing mental health issues, please seek professional help
• We do not guarantee specific results from following AI recommendations
• You are responsible for evaluating and implementing any suggestions provided

8. Privacy and Data Protection

Your privacy is important to us. Our use of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of your data as described in the Privacy Policy. Privacy Policy.

9. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the Service will immediately cease.

You may delete your account at any time through your account settings. Upon account deletion, your personal data will be deleted in accordance with our Privacy Policy.

10. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

11. Indemnification

You agree to indemnify, defend, and hold harmless SelfOS and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which SelfOS operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of that jurisdiction.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis at the then-current rate, plus any applicable taxes, until you cancel. You will be notified before any price increase takes effect. You can cancel auto-renewal at any time through your account settings or by contacting us at contact@selfos.club. Cancellation will take effect at the end of your current billing period.

Payments are processed securely through Stripe and Revolut. Your payment information is stored by these payment processors and is not stored on our servers.

If you are a consumer in the European Union, European Economic Area, or United Kingdom, you have the right to withdraw from your purchase within 14 days of subscription without giving any reason.

To exercise this right, you must inform us of your decision to withdraw by a clear statement (e.g., email to contact@selfos.club) before the 14-day period expires.

If you withdraw, we will reimburse all payments received from you, including the costs of delivery, without undue delay and in any event not later than 14 days from the day on which we are informed of your decision to withdraw.

If you begin using the Service before the 14-day withdrawal period ends, you expressly consent to losing your right of withdrawal once the Service has been fully performed. For digital content, by downloading or streaming, you consent to immediate delivery and acknowledge losing your withdrawal right.

18. Refund Policy

We want you to be satisfied with our Service. Our refund policy is as follows:

• EU/EEA/UK Withdrawal Right: You may request a full refund within 14 days of your initial subscription as described in Section 17.
• Free Trial: If you cancel during your free trial period, you will not be charged.
• Monthly Subscriptions: No refunds for partial months. Your access continues until the end of your billing period.
• Annual Subscriptions: You may request a prorated refund within 30 days of purchase if you are not satisfied with the Service.
• Exceptions: Refunds may be refused if we detect abuse of the refund policy, fraud, or violation of these Terms.

To request a refund, email us at contact@selfos.club with your account email and reason for the refund request. Refunds are processed within 5-10 business days to the original payment method via Stripe or Revolut.

19. Free Trials and Promotional Offers

We may offer free trial periods or promotional pricing from time to time. These offers are subject to the following terms:

• Free trials are available only to new subscribers who have not previously used a trial.
• At the end of your free trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.
• We will send you a reminder email before your trial ends. It is your responsibility to cancel before the trial period expires if you do not wish to be charged.
• Only one trial per person, household, or payment method. We reserve the right to limit, suspend, or terminate trials at any time.

20. Chargebacks and Payment Disputes

If you believe a charge is incorrect, please contact us at contact@selfos.club before initiating a chargeback with your bank or credit card company. We are committed to resolving billing issues quickly and fairly.

If you are unsatisfied with a purchase, please contact us and we will work with you to resolve the issue.

The content, features, and services provided through SelfOS, including but not limited to AI coaching, habit tracking, fitness suggestions, and wellness recommendations, are for general informational and educational purposes only.

• Nothing in this Service should be construed as professional medical advice, diagnosis, or treatment.
• Always consult with a qualified healthcare provider before starting any new fitness, diet, or wellness program.
• If you are experiencing a medical emergency, call your local emergency services immediately.
• Do not disregard professional medical advice or delay seeking it because of something you have read or received through this Service.
• If you have food allergies or intolerances, always verify ingredients and consult with a medical professional before following any nutrition suggestions.
• Participation in physical activity or dietary changes carries inherent risks. You assume all risks associated with the use of this Service.
• The provider makes no representations or warranties regarding the accuracy, completeness, or suitability of the information provided.
• You are solely responsible for your health decisions and outcomes. Use of this Service is at your own risk.

By using this Service, you acknowledge that SelfOS, Smart Digital SRL, and its affiliates are not liable for any health outcomes resulting from your use of the Service. You use any fitness, nutrition, or wellness features entirely at your own risk.

22. Third-Party Services and Links

The Service may contain links to third-party websites, services, or content that are not owned or controlled by SelfOS. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

• The inclusion of any link does not imply endorsement, approval, or control by SelfOS.
• You access third-party sites at your own risk and should review their terms and privacy policies.
• Our payment processing is handled by third-party providers (Stripe, Revolut). Your use of these services is subject to their respective terms and conditions.

23. User Representations and Restrictions

By using the Service, you represent and warrant that:

• You are at least 13 years of age (or 16 in the EU/EEA, or the age of majority in your jurisdiction).
• You have the legal capacity to enter into these Terms.
• All information you provide is true, accurate, current, and complete.
• You will use the Service only for your personal, non-commercial purposes unless on a Business plan.
• You will comply with all applicable laws and regulations in your use of the Service.

You may NOT:

• Sell, rent, lease, loan, or otherwise monetize the Service without our consent.
• Reverse engineer, decompile, or attempt to extract the source code of the Service.
• Use data mining, robots, or similar data gathering or extraction methods.
• Attempt to circumvent any security features or access controls.
• Create multiple accounts to abuse free trials, promotions, or avoid restrictions.

If you access the Service through an application downloaded from the Apple App Store, the following additional terms apply:

• You acknowledge that these Terms are between you and SelfOS only, not with Apple, and Apple is not responsible for the Service or its content.
• The license granted to you is limited to a non-transferable license to use the Service on any Apple-branded products you own or control.
• Apple has no obligation to provide maintenance or support services for the Service.
• Apple is not responsible for any product warranties, whether express or implied. In the event of failure to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any).
• Apple is not responsible for addressing any claims relating to the Service or your use of it.
• Apple is a third-party beneficiary of these Terms and may enforce them against you.

If you access the Service through an application downloaded from Google Play, the following additional terms apply:

• You acknowledge that Google is not a party to these Terms and has no responsibility for the Service.
• All billing and subscription management is handled according to Google Play's terms of service.
• The Service complies with Google Play Developer Program Policies.

26. Notice to California Residents

If you are a California resident, under California Civil Code Section 1789.3, you are entitled to the following consumer rights notice:

Under the California Consumer Privacy Act (CCPA), California residents have specific rights regarding their personal information, including the right to know, delete, and opt out of the sale of personal information. If you are a resident of the European Economic Area or United Kingdom, the following provisions apply:

• Your personal data is processed in accordance with the General Data Protection Regulation (GDPR) and UK GDPR. See our Privacy Policy for details.
• For disputes, you have the right to file a complaint with your local data protection authority or consumer protection agency.
• EU consumers may use the Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr for online dispute resolution.
• You have a 14-day right of withdrawal for digital subscriptions as described in Section 17.

For EU/EEA Residents: You have the right to seek recourse through the Online Dispute Resolution platform (https://ec.europa.eu/consumers/odr) or your local consumer protection agency. Nothing in these Terms limits your statutory rights as a consumer.

For Non-EU Residents: Any dispute arising from these Terms that cannot be resolved through informal negotiations shall be resolved in the courts of Romania, unless otherwise required by applicable law.

To the fullest extent permitted by applicable law, you agree that any dispute resolution will be conducted on an individual basis and not as part of a class, consolidated, or representative action.

29. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and Health & Safety Policy, constitute the entire agreement between you and SelfOS regarding your use of the Service and supersede all prior agreements and understandings, whether written or oral.

31. Notice to Romania Residents

If you are a resident of Romania, the following additional provisions apply in accordance with Romanian consumer protection laws:

• Consumer Complaints: You may file complaints with the National Authority for Consumer Protection (ANPC) at www.anpc.ro or by contacting their territorial offices. ANPC can be reached at Bulevardul Aviatorilor nr. 72, Sector 1, București, România.
• Alternative Dispute Resolution: You may also use the alternative dispute resolution mechanism through SAL-Fin for financial disputes or other ADR entities accredited by ANPC.
• These Terms are governed by Romanian law. Any disputes shall be resolved in the competent courts of Iași, Romania.
• Nothing in these Terms affects your statutory rights as a consumer under Romanian Law 449/2003 on the sale of products and associated guarantees, Law 363/2007 on combating unfair commercial practices, and Government Ordinance 21/1992 on consumer protection.
• In accordance with Romanian legislation regarding health and fitness services, we explicitly state that this platform does not provide medical services, and all health-related content is for informational purposes only. Users with pre-existing medical conditions should obtain written approval from a licensed physician before using any health or fitness features.

Data Protection: You may file data protection complaints with the National Supervisory Authority for Personal Data Processing (ANSPDCP) at www.dataprotection.ro, B-dul G-ral. Gheorghe Magheru 28-30, Sector 1, București, România.

In compliance with EU regulations regarding health-related digital services and consumer protection:

• This platform is NOT classified as a medical device under EU Regulation 2017/745 (MDR). We do not diagnose, treat, cure, or prevent any disease or medical condition.
• All health and fitness content complies with EU Regulation 1924/2006 on nutrition and health claims. We do not make unauthorized health claims.
• The information provided does not substitute consultation with qualified healthcare professionals as required by Directive 2011/24/EU on patients' rights.
• Health-related data is processed in accordance with GDPR Article 9 requirements for special categories of personal data, with explicit consent obtained where required.
• In accordance with EU consumer protection directives, limitations of liability do not affect your mandatory consumer rights or liability for personal injury caused by our negligence.
